Sir,

I am to draw your kind attention to the O.M. cited under reference No. 1 and subsequent Corrigendum dated 1.12.09 wherein the Opening of the Site Museums of A.S.I. will be revised from 08.00 A.M. to 5.00 P.M. effective from 3rd December 2009. Hitherto, since from the establishment, these Museums were open to visitors from 10.00 A.M. to 5.00 P.M. The said Office Memorandum had come as a great Shock to the Staff working in the museums.

In this connection, I write to inform you that consequent upon the revision of new Opening hours of these site Museums, the Officers and Staff posted at these site Museums are forced to reach the Museum by 07.30 A.M. so as to attend to the Sweeping/cleaning of Galleries, keeping the Galleries neat and tidy, Handing over/Taking over of Galleries and allotment of duties to the Gallery Attendants so that they can keep open the Museum to the visitors at 8.00 A.M. and has to close the Museum after the departure of Visitors at 5.30 P.M. and even more according to the quantum of the visiting tourists at concerned Museums thereby the Officers and Staff work for a additional period of Three hours per day i.e., in total 10 hours. At present, though almost all the Museums in India are lacking of staff strength, the Officers and Staff posted at these Museums are rendering yeomen service and striving hard in building up the reputation and image of the Department as also to keep up the confidence of the Superiors. Above all, majority of the Museums in India were closed on Fridays and they were getting sufficient opportunity and time to reorganize the Galleries periodically and to take up developmental activities in time to time. Consequent upon the revision of the opening hours as also to keep the Museums open on all the days of the year, the general cleaning and developmental activities in these Museums will definitely be hampered and comes to a standstill. The Staff were put into lot of inconvenience not only to avail their legitimate holidays viz., public holidays/Earned Leave/Casual Leave/Commuted leave but also their weekly holidays also. Government of India has specified the working hours of the employees and according to labour rules also, the Staff are supposed to work only for 8.00hrs a day. Though the Officers and Staff working in the administrative offices are enjoying the benefit of 2 days weekly holiday, the Officers and Staff working in the museums are getting only one day as their weekly holiday. Though there was a stiff resentment from the Officers and Staff working in these Museums across the country to implement the revised opening hours w.e.f. 3rd December 2009, this Association having due regard in your benign administration had requested them to oblige the orders of the Director General at the first instance., and assured that this Association will definitely heed to their genuine grievances. However, this Association strongly protests and condemns the undue attitude of the Directorate in this regard in whole.

Under the circumstances and facts explained above, I would request you kindly to review your decision and issue one more corrigendum immediately and restore the earlier timings in the larger interest of justice and equity.

I am of the firm opinion that you will consider our request in the right spirit and review your decision in order to protect the interest of large number of employees working in the Department who are having immense faith and due regard in your able and benign administration.

Delegation of Power to Regional Directors regarding Grant of ACP

All the Members are well aware that the power of Grant of MACP's in respect of Group A, B and C Staff was with the Directorate. Now the Director General has issued Orders delegating the Powers to the Regional Directors regarding grant of MACP's in respect of Group B (Gazetted and Non Gazetted) and Group C Staff under their Jurisdiction. Delegation of Administrative powers to the Regional Directors

Sub: Delegation of Administrative powers to the Regional Directors –
Modification of orders- requested.
Ref: Your office Order No. 88/2009-Adm.I dated 22.07.2009.

Sir,

I write to inform you that, while thanking your kindself for taking bold steps in establishing the Regional Directorate offices and delegating financial and administrative powers to the Regional Directors, I am to draw your kind attention to our discussions held on 8th July 2009 during which, you had assured us that the powers of transfers of any cadres will not be delegated to the Regional Directors. But to our surprise, the power of Transfer of Group ‘B’ (Gazetted), Group ‘B’ (Non-Gazetted), Group ‘C’ and ‘D’ within the Region has been delegated to the Regional Directors vide your Office Order cited above.

As you are kindly aware, hitherto, when the powers of transfer of all cadres through out the country were vested with the Office of the Director General, the Gr. B, C and D staff were transferred from one Circle to another Circle or Zone, only when they are promoted to the higher posts and such promotional posts were not available in their Circle/Zonal offices of other branches or when there were requests from individual officials to join their family. The powers were never misused for harassing any officers or staff members of any cadre. Now, I am sure, the powers of transfer delegated to the Regional Directors will definitely be misused to harass and black-mail the officers and low paid staff members of Gr. B (Non-Gazetted), Gr. C and D Cadres. We have living examples of harassment and blackmailing meted out to number of low paid Gr. C and Gr. D staff by some Circle and Zonal officers with limited powers of transferring them within the jurisdiction of the Circles/Zones in general and Female employees in particular. When such Gr. C and D staffs were transferred to a very distant places from their original posting, they were unable to maintain two establishments, one for themselves at the new place of posting and another at their original place of posting for the sake of their children’s education, thus, they were forced to opt for voluntary retirement. In the process, the Department has lost number of very richly experienced Group D staff who were striving hard in cleaning and removing vegetation even from a very peak of the monuments. You are kindly aware, of recent, education has become a very costly affair and every citizen has an ambition of providing good education to their children. But such unhealthy transfers of Gr. C and Gr. D staff to a far off place throws cold water on their ambition and their children have to suffer lack of good education.

Further, such transfer powers are not vested with the Directors working in the office of the Director General. There will be a great frustration among such Directors working in Directorate office without such powers on the one hand and on the other, the Regional Directors, who have enjoyed enormous powers, will hesitate to work in the office of the Director General, when they are transferred from the Regional Directorate to the office of the Director General.

Further, I would like to draw your kind attention to the Sl. No. 6 of the above Office Order wherein the powers of sanction of G.P.F. Advances in respect of all the Group A,B,C and D Officials of the Horticulture Branch has been delegated to the Chief Horticulturist. In this connection, it is brought to your kind notice that the Horticulture Branch of Archaeological Survey of India has been spreaded across the country and the staff working in this Branch are rendering yeomen service by laying out beautiful Lawns and Gardens highlighting the environs of the Nationally Protected Monuments which is being appreciated by the National/International tourists visiting these Monuments. The Horticulture Branch has at present Four Divisions located at Agra, New Delhi, Mysore and Bhubaneswar respectively and nearly 2000 employees of Group A, B,C, D are working in these Divisions and the jurisdiction of these Divisional Offices are very vast. At present though these Divisional Offices are having lack of Ministerial staff, but however they are managing to get the work achieved with the existing staff. If the said orders have to be implemented by the Chief Horticulturist stationed at Agra, the employees who are applying for sanction of G.P.F. Advances for their immediate needs feels very difficult and it may take months together to get their advance sanctioned and the main purpose of their requirements will definitely be defeated. In order to protect the interest of these staff, it is absolutely necessary that the powers of sanction of G.P.F. Advances and Final Withdrawals be restored with the Division Heads.

In the circumstances explained above, I would request you kindly to review your decision and issue a Corrigendum withdrawing the powers delegated to the Regional Directors of transferring officers and staff members of all Gr. B, C and D cadres and restore the same with the office of the Director General again in the larger interest of the justice and equity.

I hope, you will consider our request in a right spirit and review your decision in order to protect the interest of the large number of employees working in the Department having due regard in your able and benign administration.

Kindly refer this Association letter citer under reference 1 & 2, wherein this association had requested your kind self to issue necessary circulars instructing all the Head of Offices of Circles/Branches to implement the recommendation of 6th CPC regarding imparting training to the non-matriculate Group D staff working in Archaeological Survey of India for placing them in the Pay Band PB-I of Rs. 5200-20200 with Grade Pay of Rs. 1800/- p.m as also for payment of Arrears w.e.f. 01.06.2009.

In this Connection, I write to bring to your kind notice that, in spite of Clear instructions by the Govt. of India and repeated requests by this association for imparting training to the Non-matriculate Group D Staff with in time schedule, no positive steps has been initiated by the Directorate, even after about a year of implementation of 6th CPC. The eligible Group D staffs are suffering from a monetary loss of about Rs. 400 to 700 per month due to non implementing of the decisions by the Govt. of India. The retirement dates of Many Group D staffs are fast approaching. If the training to the non Matriculate Group D staff will not be implemented immediately, it will be resulting in heavy loss during the payment of their retirement benefits, as well as during the fixation of their Pension.

Under the circumstances and facts stated above as also to protect the interest of low paid employees of this Department, I would request you kindly to arrange to issue necessary circulars instructing Head of Officers of all Circles and Branches to impart training to the Non-Matriculate Group D Employees and place them in the Pay Band PB – I with Grade Pay of Rs. 1800/- p.m as also to pay the arrears w.e.f. 1st January 2006 without any further loss of time, failing which this association is compelled to approach Higher Authorities for getting justice in the right earnest of the working class.
